Welcome to The Pixel Nook Creative Studio 
By using this website, purchasing digital products, or booking creative services, you agree to the following Terms & Conditions. Please read them carefully.

If you do not agree to these terms, please discontinue use of our website and services.

1. Overview

The Pixel Nook Creative Studio provides branding, website design, digital marketing, content creation, and creative consulting services.
These Terms govern all interactions with our business, including:

  • Booking forms, quizzes, and communication platforms

  • All creative services, digital products, and downloadable content
     

2. Ownership & Copyright
All original content, designs, graphics, templates, text, and imagery created by The Pixel Nook Creative Studio remain the intellectual property of The Pixel Nook until full payment has been received.

Once the project has been paid in full:
✅ All ownership rights and creative materials are transferred to the client.
You will have full commercial rights to use, reproduce, and modify your purchased designs as desired.

However, The Pixel Nook retains:

  • The right to display completed works for portfolio and promotional purposes (unless confidentiality is requested in writing).

  • Copyright to any pre-existing brand assets, graphics, or creative materials developed prior to your project.

You may not copy, resell, redistribute, or claim The Pixel Nook’s templates or website content as your own.

3. Client Responsibilities
To ensure your project runs smoothly, clients must:

  • Provide accurate and timely information, content, and feedback.

  • Obtain proper usage rights for third-party assets (photos, fonts, logos, etc.) provided to us.

  • Respond to communications within the agreed timeframe to avoid project delays.

The Pixel Nook is not responsible for delays caused by missing, inaccurate, or late submissions.

4. Quotes, Deposits, Payments & Refunds

A. Quotes
All quotes and proposals are valid for 30 days from the issue date.
Prices are subject to change after that period or if the project scope changes.

B. Deposits

  • All projects over $500 CAD require a deposit before any design or creative work begins.

  • Deposits are fully refundable within 24 hours of payment.

  • After 24 hours, deposits become non-refundable, as time and resources are allocated to your project.

  • Remaining balances are due upon final delivery unless otherwise stated in your invoice or contract.
     

C. Payments
Payments may be made via secure payment methods (e.g., Stripe, PayPal, Wix Payments, or eTransfer).
Full payment is required before receiving final design files or transferring ownership rights.

D. Refund Policy
Due to the creative and digital nature of our services, all payments (after the refundable 24-hour window) are non-refundable.
If you are unsatisfied, we will provide revisions as outlined in your service package to ensure your satisfaction.

5. Turnaround, Revisions & Delivery
Estimated timelines are provided based on your project type.
Delivery dates depend on:
 

  • Timely client communication and approvals

  • The scope of work

  • Revisions requested
     

Revisions beyond the agreed amount may incur additional fees.
Final files are delivered in standard professional formats (e.g., PNG, JPG, PDF, AI, SVG, or Wix transfer) once full payment is received.

6. File Transfer & Usage Rights

Once full payment is received:
 

  • All design files, branding assets, and final materials are officially transferred to you.

  • You receive exclusive commercial rights to use your designs for business or marketing purposes.

  • You may print, publish, and display your purchased designs freely.
     

The Pixel Nook retains the right to:

  • Showcase completed work in our portfolio, website gallery, and marketing materials (unless otherwise requested).

  • Maintain copies of design files for record-keeping and customer support.

We are not liable for loss or corruption of files once transferred; clients are responsible for securely storing their final assets.

7. Digital Products & Templates

Purchasing digital templates or downloadable content grants you a single-user commercial license.

You may:
✅ Use, edit, and customize templates for your own brand or business.

You may not:
🚫 Resell, share, distribute, or claim templates or digital content as your own.
🚫 Remove existing Pixel Nook branding or copyrights unless explicitly allowed.
Violation of licensing terms may result in revoked access or legal action.

8. Confidentiality & Privacy
All client information, creative concepts, and communications are treated as confidential.
Your details will never be sold, shared, or disclosed, except as required by law or to fulfill a project (for example, print or hosting vendors).
Our Privacy Policy — which explains how we collect, protect, and use personal information.

9. Limitation of Liability

The Pixel Nook Creative Studio is not liable for:

  • Business, financial, or reputational losses resulting from the use of our designs or services.

  • Delays or interruptions caused by technical issues or third-party platforms (e.g., Wix, Canva, Stripe).

  • Errors in content, copy, or spelling once approved by the client.

We make every effort to deliver professional, high-quality work but cannot guarantee specific business outcomes such as increased sales or engagement.

10. Termination

We reserve the right to pause, cancel, or terminate a project if:

  • Payment terms are not met,

  • Communication stops for 14 days or more, or

  • The client violates these Terms.

In such cases, all completed work up to that point remains the property of The Pixel Nook until payment is made in full.

11. Third-Party Tools & Links

Our website may include links or integrations with third-party tools (such as Wix, Canva, Stripe, and Instagram).
We are not responsible for the content, privacy practices, or performance of these external sites.
Use them at your own discretion.

12. Governing Law

These Terms & Conditions are governed by and interpreted in accordance with the laws of the Province of Alberta, Canada.
Any disputes will be handled in Alberta jurisdiction.

13. Changes to Terms

We may update these Terms from time to time to reflect operational or legal changes.
Revised Terms will be posted on this page with an updated “Last Updated” date.
Continued use of our website or services indicates acceptance of any changes.
